TERMS AND CONDITIONS
Thames Tigers is a trading style of 88 London Ltd - Company Registration number 10492083, hereinafter called ‘The Company’.
In making a booking with The Company you acknowledge that you agree to be bound by the following terms and conditions.
Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
The Company shall not be liable to any passenger for any loss or damage which arises out of or in connection with or as a consequence of the operation of The Company’s boat service including, but not being limited to, loss of profit, damage to or loss of property or items belonging to the passenger and any personal injury to the passenger (except where such injury is caused by The Company’s negligence).
BOOKINGS
All bookings must be paid for at the time of booking. Bookings are non-refundable and will only be transferred to other individuals and/or other services at the discretion of The Company.
The Company will on occasion need to change or cancel bookings as a result of river closures, technical issues or lack of bookings for a particular service. Passengers will be given the option of a full refund if no suitable alternative booking is available. The Company’s liability to the passenger will be limited to the cost of the ticket in the event of such cancellation.
On occasion the route of a trip will be amended due to circumstances outside the control of The Company. This may include landing at an alternative pier or making an emergency return to a pier. Passengers will be advised of such changes at the earliest opportunity. The Company will not offer refunds in such events.
As long as it is safe to do so, voyages will take place regardless of the weather. Refunds or re-bookings will not be permitted as a result of poor weather.
Prices are in GBP and are zero rated for VAT.
The River Thames can be very busy and the Port of London Authority impose strict speed limits. The Company’s vessels are licensed by the PLA to exceed the standard 12 knot speed limit in certain parts of the river providing no danger or inconvenience is caused to other users of the river. Your trip will include periods at below 12 knots where the skipper deems it necessary.
You should arrive for your trip at least 15 minutes before the scheduled departure time. This is to allow time to don wet weather clothing and a life jacket and to receive a safety briefing. Scheduled departures cannot be delayed to accommodate late arrivals as this has a knock on effect to later departures. Passengers arriving late will not be eligible for a refund. If space is available on a later trip this MAY be offered at the discretion of The Company.
In the event of a malfunction of the vessel that affects the trip The Company will, at its discretion, depending on the degree of impact on the planned trip, offer compensation in the form of a partial/full refund or alternative booking.
AGE AND HEIGHT RESTRICTIONS
All children under the age of 14 must be accompanied by an adult. Suspension seats are suitable for those over the height of 5ft (1.5 metres). However, a limited number of seats are available on each voyage for persons over 4ft 6inches (1.37 metres).
FITNESS TO TRAVEL
The Company’s vessels include high quality suspension seating. These seats almost eliminate the effects of shock on the body caused by the boat impacting waves. However, the decision on whether an existing medical condition will preclude a passenger from travelling will have to be made by the passenger in consultation with a suitably qualified medical professional. Pregnant ladies at any stage of pregnancy are advised not to travel. The Company advises any person with a condition likely to be affected by the conditions experienced on a high speed boat ride, including high speed turns and wave impacts, not to travel and cannot be held responsible for injury or loss as a result of ignoring this advice.
Passengers must remain seated throughout the voyage for their own and others safety, unless instructed by the skipper.
The skipper has absolute discretion on who he/she considers fit and safe to travel and will refuse to allow any person they deem to be a risk to the safety of themselves, others or the vessel to board. This includes any person unfit through alcohol or drugs; persons acting in a threatening or abusive manner and anybody that they consider will spoil the enjoyment of other passengers. Passengers refused permission to board will be offered a refund only at the discretion of The Company.
PROHIBITED ITEMS
Smoking is not permitted on board the vessel. Food and drink can only be consumed on the vessel with permission of the skipper. Any bag or other item brought onto the vessel must be kept securely by the passenger and not allowed to block gangways. Litter or any other item must not be thrown overboard or dropped on the deck and must be removed on disembarkation. Offensive weapons, including knives and other sharp objects, fireworks or any item likely to pose a risk to the vessel or its passengers may not be carried on board the vessel. Passengers agree to allow their bags to be searched prior to boarding.
LIFEJACKETS
Automatic inflating lifejackets are provided for all passengers and must be donned prior to boarding and kept on throughout the voyage. The lifejackets are fitted with a cord to activate manual inflation. This cord is only to be used in an emergency. Any passenger inflating a lifejacket without good cause will be required to pay for the servicing and replacement gas cylinder in the lifejacket, at a cost of £50.00. The lead passenger will responsible for this payment.
CLOTHING
The river can be significantly colder than expected and the effects of travelling at speed can add to this. Every effort will be made to keep passengers dry but you may experience a degree of water spray in certain conditions. Please come appropriately dressed, including shoes that will not be damaged by water on the boat deck. The Company will provide protective jackets, over-trousers and eye protection when required. The Company will not accept liability for loss or damage to clothing or possessions caused by the weather conditions or left on the departure pier.
All protective clothing and lifejackets must be removed and left on the pier after disembarkation. A charge will be made for any property removed from the pier.
Other than liability for death or personal injury resulting from The Company’s negligence, The Company, its employees or agents shall not be liable for any loss or damage, direct or indirect, howsoever arising, including without limitation any distress, inconvenience or anxiety caused during the course of any voyage undertaken and/or during disembarkation from the vessel in the event of an emergency.
DISABLED PASSENGERS
We are happy to welcome passengers with disabilities onto our vessels. The nature of our voyages obviously preclude many individuals from participating. However, we will work to accommodate anyone wishing to take part as long as this can be done safely.
LUGGAGE
You may bring small items of luggage and handbags on board and keep these with you during the voyage. We do not have facilities to carry suitcases or other large items on the vessel; These may be left in the company's locked kiosk on Tower Bridge Quay at the passengers' risk. Please keep your personal items to a minimum. The Company cannot be responsible for the loss or damage of any item left on a pier during a voyage.
PHOTOGRAPHY
You are welcome to take pictures of your experience but we are unable to accept liability for damage to any camera or mobile phone used during the voyage, including those handed to The Company’s employees to take pictures.
The Company occasionally take photographs or video for publicity purposes. If you object to appearing in these images please make this clear at the time. Failure to do so implies that you are happy for these images to be used for any purpose The Company deems fit and that you will not claim any rights over these images.
BY AGREEING TO THESE TERMS AND CONDITIONS THE PERSON MAKING THE BOOKING HAS CONFIRMED THAT ALL PASSENGERS ARE AWARE OF THEM AND AGREE TO BE BOUND BY THEM.
